What is Contempt of Court?
A Court Order MUST be followed. Failure to follow the orders of a court is Contempt of Court. There are two (2) basic types of contempt: 1) civil contempt and 2) criminal contempt. Failure to follow a court order can result in a person going to jail or paying fines, court costs, and attorneys fees. To enforce a court order, a Petition for Contempt must be filed in the Court which entered the Order being violated. Contrary to public opinion, courts do not automatically enforce its own Orders; parties must hire an attorney to file a Petition for Contempt.
Typical Contempt of Court Charges:
- Failure to pay child support
- Failure to pay alimony
- Failure to sign documents necessary to complete the transfer of property
- Failure to provide a child with health care benefits
- Failure to pay attorney fees
- Failure to surrender property/allow access to property
- Failure to follow child custody or visitation orders
- Making derogatory remarks about the other parent in front of kids
