Penalties for Prostitution Offenses

Prostitution charges in Tennessee are mainly associated with a misdemeanor with the exception of a felony charge for pimping. Under Tennessee prostitution law, crimes are punished more severely if prostitution occurs within 100 feet of a church or 1.5 miles of an elementary, middle or high school(s). Promoting prostitution (pimping) is a Class E felony — 1-6 years in prison and a maximum fine of $3,000. Prostitution or soliciting prostitution within 100 feet of a church or 1.5 miles of an elementary, middle or high school(s) is a Class A misdemeanor — maximum 11 months and 29 days in jail and a fine no more than $2,500. Soliciting prostitution is a Class B misdemeanor — maximum 6 months in jail and a fine no more than $500. The most serious offense is aggravated prostitution, which is prostitution while knowingly HIV-positive, and that is a Class C felony — 3-15 years in prison and a maximum fine of $10,000.
