Halle Berry Seeks Child Custody After Filing for Divorce

halley berry files for child custodyHalle Berry has filed for divorce from husband Olivier Martinez for the second time this week. The first time she filed for divorce, she believed it was smart to use aliases so the divorce would not gain national and media attention. In the initial divorce papers, Berry used the alias of “Hal Maria,” Martinez was “Oliver Martin” and two-year-old son Maceo was “Mac Martin.” It is unclear if filing for a divorce under aliases are legal, but it is hard to imagine it would be. Berry and Olivier have a prenuptial agreement in place, so both parties will be able to keep their respective earnings. Berry is requesting custody of Maceo for his “best interests,” but Martinez is seeking joint custody.

Battle For Petitioner

Only in Hollywood would there be a fight about being the petitioner. In a divorce, the petitioner is the party filing for divorce. Basically, the battle is about who is divorcing who. Martinez filed for divorce, as well, in response to Berry’s initial pseudonym divorce filing. Berry came back with legitimate divorce papers, herself. A battle is brewing, but it will ultimately be up to the judge to decide who is divorcing who. God forbid their reputations be at stake!

Child Custody in Tennessee

Once both sides figure out who the petitioner will be, finalizing the divorce will be a simple process because it is uncontested. In divorce cases, judges take a look at all facts of the case: grounds, division of property and debts, alimony, child custody and child support. The biggest obstacle in the case will be child custody. Without probable cause against Martinez, Berry will not be able to take sole custody of Maceo. In Tennessee, the courts always look out for the best interests of the child. When determining child custody, a judge is required to perform a comparative fitness test on both parents. Afterwards, the court will make a Permanent Parenting Plan that will legally address the child custody status.
